Fair Housing Advertising

 

As many of you have noticed, we now have a new feature in MATRIX that alerts you to possible Fair Housing Advertising Word violations.

This feature alerts you to possible HUD violations at the time you click the submit button.

If you are alerted to a possible violation, please click the "continue editing" button to review the public remarks section on your listing and modify if necessary.

This feature does not hinder you from submitting your listing. You do still have the ability to submit the listing with the possible violations by clicking the "Submit Listing" button.

New Features Now Available In MATRIX

MATRIX will have a new feature that will be available within the next week. This feature is Realist Auto Pop.

This feature will allow you to automatically populate the address and legal description fields for your listing in the MLS based on the property information provided by Realist. The implementation of this feature is an attempt to minimize MLS violations by ensuring that the information you provide coincides with the information provided by your parish tax assessor.

When this feature is available, you will notice a new button in the input section in MATRIX.

In order to use this feature, you will click the "Fill From Realist Tax" button.

You will then be prompted to select a parish and enter either the street number and street name or the Tax ID number.

This will allow you to automatically populate the address and legal description fields.

Helpful Reminders

Section 1.9 DUPLICATE FILINGS OF LISTINGS:  If entered under more than one property type, one of the entries must be withdrawn when the property is sold or leased.

A participant cannot enter a property more than once under the same property type.

Section 1.10 CO-LISTINGS:  When "co-exclusive" listings, which make it possible for the listing broker to offer cooperation and compensation to the other Participants of the Multiple Listing Service acting as sub agents, buyer agents, or both, are included in the MLS compilation, each of the "co-exclusive" listing brokers must be REALTORS® or Participants in GSREIN. Co-Listings maybe entered into the MLS once with each of the listing agent's names and brokerage information appearing on the listing.

This will keep listing and sold statistics from being distorted. (Amended 11/2016)

Please be advised of the following changes to the MLS Rules and Regulations.

 

Co-Listings - Co-listings may only be entered into the MLS ONCE with each of the listing agent's names and brokerage information appearing on the listing. This will keep listing and sold statistics from being distorted.

 

Withdrawal of a Listing Prior to Expiration - A listing cannot be withdrawn and relisted by the same brokerage prior to the expiration date of the original listing. If a listing is withdrawn temporarily, the original listing must be reactivated rather than entered as a new listing.

 

When a listing is cancelled and all necessary signatures have been obtained on a cancellation agreement, the expiration date may be changed to reflect the date on the cancellation agreement. When a listing has been cancelled, said property cannot be relisted by the same brokerage for a period of 30 days.

Subsequent Fining - If an agent receives a fine, they are given 30 days to pay the fine and 72 hours to correct the violation. If the violation is not corrected within the 72 hour period, the fine will be escalated to the next fine level.

Example: If an agent receives a fine of $100, they will be given 72 hours to correct the violation and 30 days to pay the fine.

 

If the violation is not corrected within the 72 hour period, the agent will then receive a second fine of $250. The agent will be given 72 hours to correct the violation.

 

If the violation is still not corrected during the 72 hour period, the agent will receive a third fine of $500.

Please be aware of any violation notices that you receive and make the necessary corrections within the 72 hour period to avoid escalation to an additional fine.

 

Our new automated compliance program is now in full effect and is functioning as it should.

During the first couple of weeks, we had a huge number of violations, but since the notices have been going out, we have seen that number drop drastically. We went from over 1000 violations in the first week to a recent average of 20-30 per day.

The MAJORITY of violations that the system has detected are for "Failure to Update the Status of a Listing a Timely Manner." Please keep in mind that when your listing requires a status change, you have 72 hours (excluding weekends and holidays) after authorized change is received by the listing broker to update the status in the MLS without being penalized.

Some of you may have noticed that the Checkit feature is not available for incomplete listings. We sincerely apologize for this issue. The Checkit feature will only function on listings with statuses of Active, Under Contract, Pending Continue to Show, Open Predication, Leased, Sold, and Withdrawn.

Did You Know? Commission To Co-op Participant

When displaying a variable in the commission to cooperating broker such as x on the 1st $100,000 and y on the remainder, it is to be displayed as a % or $ amount on the 1st  $100,000, separated by a slash (/), and then a % or $ amount on the remainder. When there  is a variable other than so much on the 1st  $100,000 and so much on the remainder, it must  be noted in the 1st line of the Agent Remarks. (Example: TCMP % x/y or TCMP % REM).

 

DIVISIONS OF COMMISSIONS Section 5 of the MLS Rules and Regulations.

COMPENSATION SPECIFIED ON EACH LISTING:

In filing a property with the Multiple Listing Service of a Board of REALTORS®, the Participant of the Service is making blanket unilateral offers of cooperation to the other MLS Participants, and shall therefore specify on each listing filed with the Service, the compensation being offered to the other MLS Participants. Specifying the compensation on each listing is necessary, because the cooperating broker has the right to know what his compensation shall be prior to his endeavor to sell.

The commission offered to the co-operating broker through the MLS may be in the form of a (%) percentage or ($) a dollar amount. Be sure to read this field carefully so there is no misunderstanding as to the amount of the offer of compensation.

Basic listing edit forms are now available within Matrix Mobile. These same forms may be accessed within GoMLS to support editing of listings from within that app.

NOTE: Only editing of existing listings is supported, and not entry of new listings. These forms are not intended to provide a comprehensive listing form with all fields, but rather basic "quick updates" such as price, status and remarks changes.
